Alan Keyes Sues Barack Obama Over Eligibility

'Constitutional crisis' looming over Obama's birth location

Not that long ago we asked "what's the deal with Obama's birth certificate and citizenship status?"

Apparently the story isn't quite over yet. According to Gateway Pundit, Ambassador Dr. Alan Keyes; Dr. Wiley S. Drake, Sr.; and Markham Robinson are suing Barack Obama over his eligibility to be president. Sound Investiments has a copy of the petition (pdf).

The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama’s status as a “natural-born citizen,” a requirement set by the U.S. Constitution.

WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama’s birth. But his research and discoveries only raised more questions.

The biggest question still remains is why Obama, if a Hawaii birth certificate exists, simply hasn’t ordered it made available to settle the rumors.

Here's the bottom line: I'm no fan of post election litigation madness.... and if the suit were to be successful we would potentially have mayhem on our hands. But in the final analysis, the people do deserve to know if Obama, or any candidate running for the office, meets the most fundamental requirement necessary to become President -- citizenship. Either our constitution matters or it does not, and I'd like to think that it still does.

Unavoidable scenario: If SCOTUS disqualifies Obama BEFORE 1/20/09 inauguration, McCain is POTUS per remaining electoral college electors; if SCOTUS disqualifies Obama after 1/20/09 inauguration, Hillary likely becomes POTUS per vote of Dem controlled House of Rep. Either way, is clear Obama will NOT be or remain POTUS.

I think Ted is mistaken. He's got the pre-inauguration scenario right. But post-inauguration, I believe Joe Biden would become our President by Constitutional sucession.

This does raise some interesting issues. Thankfully, it is Alan Keyes who is suing Obama, so Black America cannot so easily blame Obama's potential disqualification on "the man" sticking it to them again.

Furthermore, although this post-election challenge would still result in substantial mayhem (riots, anyone?), the American people do deserve to know. And a post-elections would not be necessary were it not for the ridiculous prior court ruling that a citizen/voter did not have standing to enforce the Constitution.

Finally, Keyes' challenge will either prove or disprove my earlier analysis that, if voters do not have standing because the "harm" is too remote, then the court would have to consider a challenge by a fellow candidate for President because the harm is not remote at all. Obama would have illegally won votes that would have gone to the other candidates, including Keyes. And Keyes does not even have to argue that he would have won, were it not for Obama. Third parties have to garner a bottom threshold of votes in order to qualify for federal funding, so political momentum is crucial for them.

Sorry, I know I said "finally" earlier, but I just thought of one more important issue. If you like irony or payback, you'll love this: Obama first won his Illinois Senate seat (which started his political career) by beating Keyes, who subbed at the last minute for a Republican who had withdrawn because he was embroiled in a scandal. Keyes did not even live in the state at the time, and he got trounced. Now Keyes has an opportunity to REALLY get revenge....
